Campfire Sauna Waiver

Campfire Sauna and Social, LLC Waiver, Release of Liability, and Assumption of Risk Agreement This Waiver, Release of Liability, and Assumption of Risk Agreement is entered into by the undersigned in favor of Campfire Sauna & Social, LLC (“Campfire Sauna”). In consideration of being permitted by Campfire Sauna to participate in the services offered by it and in recognition of Campfire Sauna’s reliance hereon, I agree to all of the terms and conditions set forth in this Agreement. PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING AGREEMENT. 1. Assumption of Risk I understand that participation in sauna and cold exposure sessions involves inherent risks, including but not limited to: elevated heart rate and blood pressure, dizziness, fainting, dehydration, aggravation of pre-existing medical conditions, property damage, financial or economic loss, and in rare cases, serious injury, temporary or permanent disability (including paralysis), or death. I voluntarily assume full responsibility for all risks, both known and unknown, associated with the use of the sauna, surrounding facilities, and any related activities (collectively, the “Facilities”), whether caused by the negligence of Campfire Sauna, the Wilmette Park District, a third party, or otherwise. I acknowledge that I am voluntarily participating in use of the Facilities with knowledge of the dangers involved. 2. Waiver of Liability/Indemnification I, on behalf of myself, my spouse/domestic partner (if any), children and all other family members, and my and their personal administrators, heirs, executors, personal representatives, and assigns, hereby release, waive, and discharge Campfire Sauna, its present and former owners, directors, officers, employees, agents, contractors, and affiliates, and the Wilmette Park District, its present and former directors, officers, employees, agents, contractors, and affiliates (collectively the “Released Parties”), from any and all liability for any loss, expenses (including but not limited to attorneys’ fees and court costs), injury, illness, death, or property damage, including without limitation, counterclaims, cross-claims and third party claims, demands, or other liabilities of whatever kind, nature or description, whether known or unknown, direct or indirect, which arise from, or out of, are related to, or caused by my participation or use of the Facilities (“Claims”). This includes liability arising from negligence to the fullest extent allowed by law, but does not extend to claims for gross negligence, willful and wanton misconduct, or any other liabilities that Illinois law does not permit to be released by agreement. I further agree to indemnify, defend, and hold harmless the Released Parties with respect to any and all such Claims. I covenant not to make or bring any such Claims against the Released Parties, and forever release and discharge the Released Parties from liability for such Claims. 3. Health Conditions/Consent to Treatment I confirm that I am in good physical health and able to safely participate in sauna and cold immersion activities. I have consulted with my physician prior to participation in the Facilities if I have any of the following conditions: cardiovascular disease, high or low blood pressure, respiratory illness, pregnancy, or any other medical condition that could be exacerbated by heat or cold. I acknowledge that it is my responsibility to monitor my own health during participation and that if at any time I am no longer in the proper physical condition to use the Facilities or begin to experience symptoms of any illness, I will immediately discontinue further use of the Facilities until such time as I return to good health and proper physical condition. I hereby consent to receive from any licensed hospital, physician, or medical personnel any medical treatment deemed necessary if I am injured or require medical attention during my participation in the Facilities. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. 4. Property Damage and Conduct I agree to treat all Campfire Sauna property, facilities, and equipment with respect. I accept full financial responsibility for any damage caused by my negligence or misconduct. Campfire Sauna reserves the right to deny entry or remove any individual who behaves in an unsafe, disrespectful, or disruptive manner, including but not limited to: intoxication, failure to follow safety protocols, or vandalism. 5. Water Access Prohibition and Liability Waiver Entering Lake Michigan or any surrounding body of water is strictly prohibited during or after sauna sessions unless otherwise permitted by the Wilmette Park District. Campfire Sauna does not supervise water access and assumes no responsibility for water safety. If I choose to enter the water against this policy, I do so entirely at my own risk, and I expressly release, defend, indemnify, and hold harmless the Released Parties from any and all Claims, or other injuries, accidents, illness, or death that may result from such action. I acknowledge this policy has been clearly communicated to me, and any violation may result in immediate termination of my participation without refund. 6. Photo/Video Release (Optional) ☐ I grant Campfire Sauna permission to use any photos or videos taken during my visit for promotional or marketing purposes. ☐ I do not grant permission for photo/video use. 7. Severability The invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any other provision hereof. In the event that any one or more of the provisions of this Agreement shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remainder hereof shall not in any way be affected or impaired thereby, and any such provision or provisions shall be enforced to the fullest extent permitted by law. Moreover, if any one or more of the provisions contained in this Agreement is held to be excessively broad as to duration, scope, activity, or subject, such provisions will be construed by excising, limiting and/or reducing them so that this Agreement is enforceable to the maximum extent compatible with applicable law. 8. Jury Waiver I knowingly, voluntarily, and irrevocably waive any and all rights to a trial by jury in any action, proceeding, or counterclaim arising out of or relating to this Agreement, my use of the Facilities, or any dealings between the parties. 9. Attorneys’ Fees If Campfire Sauna brings any claim for breach of or to enforce any provision of this Agreement, it shall be entitled to its reasonable attorneys’ fees and court costs in connection with the claims on which it prevails. ELECTRONIC SIGNATURE CONSENT By completing this form, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have your current email address in order to contact you regarding any changes if necessary.
